There is no definitive answer to this, as it depends on several factors. Usually, there are import charges when importing goods from the United Kingdom, but there are some cases where import duty and VAT exemption are granted. Exemption from tax and VAT can be granted on a sample of a product if:

• Once imported, they can only be used as sample products

• Are of negligible value.

• Intended to win orders for the commercial product they represent (i.e. are not fully functional)

Customs can change their exact figures, but at the time of writing, goods with a commercial value (goods value + postage + import duty + insurance) over which are subject to VAT. There is a higher threshold for UK duty, and goods with a market value over are also subject to UK duty. The exact figures can be found here on the HMRC website.

It’s difficult to tell the customs that the goods are a sample. Customs impose requirements on importers for “product samples” and can seize goods if these are not met.

The requirements for importing a product from a foreign country for sampling purposes are to do one or more of the following:

• Have the product torn, punctured, cut, or made illegible by your supplier

• Make sure the product is permanently marked

What items are exempt from import duty in Kenya?

• Products that can be used other than samples

• Products intended for consumption

If the customs authorities exempt the product from excise duty because it is considered a sample, they also exempt the product from VAT.

• “Import VAT” in demystifying detail

VAT on imports from outside the EU is not only levied on the purchase cost of the goods. You pay VAT on all UK purchase and delivery costs.

What are the VAT rules in the EU?

When your EORI number is viewed by UK customs, if attached to your VAT number, they will assume that HMRC will usually send you a certificate as proof that you have paid the import VAT. C79 certificates are issued automatically (not by mail) and must be received around the 24th of the month following enrollment.

You can contact HMRC for a replacement form if you have lost or have yet to receive a C79 form from an importer. HMRC has kept track of all C79 forms for the past six years. Typically, it takes about 2-3 weeks for a replacement to be processed.

• The correct tax and VAT values for your product

• If you can apply for a preferential rate on imports from specific countries (using the Generalized System of Preferences (GSP))

• If you need an import permit (for plants/animals/dangerous products, etc.)

• Whether anti-dumping duties apply (when goods are exported below the documented value)

How does it work?
